On June 29, 2023, the U.S. Supreme Court rendered its decision in a landmark case on affirmative action that created a huge upheaval in college admission offices. In a 6 to 3 decision that fell along the political leanings of the justices, the Court struck-down longstanding affirmative action plans at Harvard and the University of North Carolina that gave racial preferences to black and Hispanic applicants. More recently, conservative activist groups are using this case – which is in the college arena – to attack Diversity, Equity and Inclusion (“DEI”) programs by filing lawsuits against employers in the private sector. These plaintiffs are arguing that the prohibition against giving one race an advantage over another when it comes to college admissions should apply the same in hiring and promotions.
